Terms of Service

Welcome to Orchrd. These Terms of Service (“Terms”) govern your use of the Orchrd platform at myorchrd.app, operated by Orchrd (“we,” “us,” or “our”). By creating an account or using our platform, you agree to these Terms.

1. Account Registration

To use most features of Orchrd, you must create an account. You agree to provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 13 years old to create an account.

2. Platform Services

Orchrd provides the following services:

  • Collection Management: Tools to track, photograph, and document your plant collection with observations and trait data.
  • Discovery: A public directory of plant varieties contributed by the community.
  • Marketplace: A platform for users to list, buy, and sell plants, cuttings, seeds, and related items through individual seller storefronts.
  • Trading: Tools for collectors to propose and complete direct plant trades with provenance tracking.

3. Subscription Plans

Orchrd offers a free tier (up to 10 plants) and a Grower plan ($36/year, unlimited plants). The Grower plan includes a 30-day free trial. Subscriptions are billed annually through Stripe. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.

4. Marketplace Terms

For Sellers

  • You must accurately describe your listings including plant identity, condition, and quantity.
  • You are responsible for fulfilling orders, including packaging and shipping.
  • Listings must comply with all applicable laws, including plant import/export regulations.
  • You must not list prohibited or illegal items.

For Buyers

  • Purchases are transactions between you and the seller. Orchrd facilitates the platform but is not a party to the sale.
  • Review listing descriptions carefully before purchasing.
  • Contact the seller directly for questions about specific items.

Payments

All marketplace payments are processed through Stripe. By using our marketplace, you agree to Stripe's terms of service. We do not store payment card information on our servers.

5. User Content

You retain ownership of content you create on Orchrd (photos, observations, blog posts, listings). By posting content on public areas of the platform (public profiles, explore, marketplace, blog), you grant us a non-exclusive, worldwide license to display that content as part of the platform's operation.

You agree not to post content that is illegal, infringing, harassing, misleading, or otherwise violates these Terms.

6. Plant Data & Taxonomy

Orchrd provides botanical taxonomy data sourced from authoritative databases. This data is provided for informational purposes. We do not guarantee the accuracy of species identifications, common names, or classification data. Plant naming is complex and subject to ongoing scientific revision.

7. Provenance & Trust

Orchrd records chain-of-custody history for plants that are purchased, traded, or transferred through the platform. Provenance data reflects user-reported information and platform transactions. External origin claims are contextual assertions — they are not independently verified by Orchrd and should not be treated as guaranteed truth.

8. Prohibited Conduct

You agree not to:

  • Use the platform for any illegal purpose
  • Misrepresent your identity or plant varieties
  • Scrape, harvest, or bulk-collect data from the platform
  • Interfere with or disrupt the platform's operation
  • Circumvent any security measures or access restrictions
  • Create multiple accounts to evade bans or restrictions

9. Intellectual Property

The Orchrd platform, including its design, code, and branding, is our intellectual property. The taxonomy database is compiled from publicly available botanical data. User-contributed content remains the property of the contributing user, subject to the license granted in Section 5.

10. Disclaimer of Warranties

Orchrd is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or that plant data will be accurate or complete.

11. Limitation of Liability

To the maximum extent permitted by law, Orchrd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of plants, failed transactions, or data loss.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through your account settings. Upon termination, your right to use the platform ceases immediately, though we may retain certain data as described in our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the revised Terms with an updated date. Continued use of the platform after changes constitutes acceptance.
